12/24/17 Update:

We are now able to sell new and certified pre-owned 3.0L TDI models. We have Certified Pre-Owned Touaregs as well.

10/23/17 Update:

Today, the government and related agencies approved an Emissions Compliant Recall (ECR) for Generation 2 3.0L TDI vehicles today. They have broken up the Generation 2 vehicles into two sub categories. Generation 2.1: 2013-2014 model years and Generation 2.2: 2015-2016. You should be receiving a letter and booklet in the mail describing the repair in more detail.

What you need to know:

November 6th will be the first date in which you can schedule an appointment to complete the ECR. Please register through the portal ( https://claims.vwgoa.com/#/) and set your appointment through our online scheduling page.
Gen 2.1 repairs will take approximately 3 hours and Gen 2.2 repairs will take approximately 1 hour.
Gen 2.1 repairs will be both hardware and software, while Gen 2.2 repairs will be software only
The ECR is only eligible for customer vehicles at this point.
The repair will come with a 10 year/120,000 mile from the original in-service date or 4 year/48,000 mile from emissions modification (whichever occurs first) extended warranty on the entire exhaust gas after treatment system, the entire fuel system, the EGR system, turbocharging system, ECU, TCU, OBD, and engine long block.

7/27/17 Update:

Today we received news that Gen 1-2.0L (2009-2014 Jetta, Golf, Sportwagen, & Beetle) vehicles received approval for customer owned vehicles to be able to perform the emissions modification and receive a restitution payment. We expect to be able to perform these at the dealership by August 11th. We are still unable to buyback and resell the Gen 1 vehicles as this approval is for customer vehicles only.

We have completed over 50 Gen 1-3.0L buybacks and trade-ins. We are still awaiting news on the Gen 2-3.0L approved emissions modification. VW has until October 23rd to get approval for these vehicles. If not, we expect they will qualify for the buyback and trade-in process.

Last week VW received approval for a Gen 2-2.0L (2012-2014 Passats w/ auto transmission) emissions modification. We are now able to perform the emissions modification on customer vehicles and resale these buyback vehicles.

Please note we are also performing emissions modifications and reselling buybacks of Gen 3-2.0L (2015 TDI models) as well.

7/5/17 Update:

Please note, all Gen 2 3.0L requests for 50% participation payments are awaiting approval. VW USA has until the end of October to get approval for the emissions modifications.

7/1/17 Update:

We are getting close on the buyback process! Stay tuned for more updates on the 3.0L settlement

5/18/17 Update:

Yesterday, the courts approved the 3.0L TDI V6 settlement. We expect eligible customers will be able to register for the settlement at www.vwcourtsettlement.com within the next 15 days. We expect to start the first buybacks, trade-ins and lease terminations in July. If you would like to move forward with this program I urge you to sign up as quickly as possible as a large bottleneck arose during the beginning of the 2.0L TDI buyback which pushed appointments out over 6 months from initial registration.

We are expecting the following changes with the 3.0L settlement versus the 2.0L settlement.

  • For Gen 1 (’09-’12 TDI Touareg owners) a trade-in option has been approved. You will need to select this option and which approved dealership you choose to do it with. Please note you will have to purchase a replacement vehicle after you facilitate your buyback. Some allowances can be made for incoming or in transit vehicles. In the state of Colorado buyers receive a tax credit on the purchase of a new or used vehicle in the amount of the value of the trade-in, up to the value of the vehicle they are purchasing. In Denver this would be a $3,442.50 savings on a $45,000 buyback.
  • Volkswagen’s staffing in the dealership to facilitate these buybacks will be reduced starting in June. There are significantly less 3.0L VW customers than 2.0L customers however we still expect to be doing 2.0L buybacks and initially this will create longer than wanted scheduling times.
  • Gen 2 (’13-’16 TDI Touareg owners) can register for a preliminary payment prior to the approved emissions modification being approved and performed on your vehicle.

5/10/17 Update:
Today, the final approval hearing for the 3.0L TDI V6 settlement took place before federal court Judge Charles R. Breyer in San Francisco. Judge Breyer said he would approve the settlement and will issue a final ruling no later than May 17

4/15/17 Update:

As of 4/14 all new 2015 2.0L TDI models have been released for sale. We have an incredible 2 year lease with $8,500 in customer cash* or 0% APR up to 72 months and $5,000 in customer cash*.
We have also learned that 3.0L TDI buybacks will start on July 1, 2017 as long as they receive final approval on May 11th. The emissions modification should start closer to October of 2016. *WAC

4/1/17 Update:

To date VW has completed 215,000 buybacks and 5,500 emissions modifications. Today VW has secured regulatory authorization to begin sales of 2015 model vehicles that have undergone an Approved Emissions Modification. They expect to receive approval for emissions modifications of all 2.0L diesels within the coming months. This will allow all TDI owners the option to keep their vehicle and dealers the ability to repurchase TDI buybacks for resale.

2/14/17 Update:

Today the Court granted preliminary approval to the class action settlement agreement we reached with the lawyers representing affected 3.0L TDI V6 customers in the United States.

The 3.0L TDI settlement program remains subject to final approval by the Court and eligible customers will now receive extensive notification of their rights and options. Volkswagen will begin the 3.0L TDI settlement program as soon as the Court grants final approval. A final approval hearing has been scheduled for May 11, 2017.

1/10/17 Update:

Emissions Modification Update:

On Friday the EPA and CARB approved the emissions modification for Gen 3, 2.0L TDI vehicles. This is any 2015 TDI Jetta, Beetle, Beetle Convertible, Golf, Sportwagen, or Passat. The first available appointments for the emissions modification will start on January 12th. This will be a two-phase modification, the first being software and the second being hardware. You will receive two thirds of the restitution payment after the 1st phase and the remaining one third after the second is completed. The second modification is expected to start in early 2018 and no later than June 30, 2019. Along with the modifications your vehicle will also be granted an extension of its Emissions Warranty to the greater of 11 years or 162,000 miles from the original in service date or 5 years or 60,000 miles from the completion of the Phase 2 modification. You will receive further notice from Volkswagen outlining the impact of these modifications on drivability, emissions, fuel economy, and Adblue/DEF usage. Please do not call the dealership to schedule a service appointment for the emissions modification. It must be completed through the settlement portal via our xtime online scheduling client.

Buyback Update:

Volkswagen continues to make strides in getting through the backlog of buyback applications. We have heard from many of you that this has been a prolonged and tenuous process. We continue to submit your feedback to VW as per court order the dealers are solely a destination for this transaction to take place. Below are the most common causes of delays in receiving your formal offer from VW. Please note that all correspondence regarding this matter are made through the portal so please check that before calling the call center at https://claims.vwgoa.com/#/.

  • Incorrect original mileage
    • Some customers guessed at their mileage when initially submitting their information. This mileage is carried over and only allows for up to 1042 miles per month to calculate a proper buyback amount per the settlement. We urge you to select EFT versus check because during your buyback appointment, when the final mileage is noted the buyback amount can be adjusted. If you select to receive a check and your mileage differs you will have to reschedule for a later appointment, which can be several months out.
    • If you decide to use check as the form of payment please make sure to enter the correct mileage of your TDI when you book your appointment and understand the adjustments made monthly and how they can impact the ability for the settlement to be completed when choosing that source as a payment.
  • Lien information
    • VW has struggled to receive payoff information from certain banks/lien holders as this is the first time a manufacturer has requested this information. Please make sure if your lien holder is not VW Credit that all information provided is correct and up to date.
  • Further information needed in the portal
    • Please check the portal for all correspondence. All documents and communication will come through the portal. If you elected to receive emails you can be notified to check the portal by email.

With the holidays behind us VW is operating at greater capacity and we currently have 167 buyback appointments scheduled over the next 30 days. Feedback from customers is saying that buybacks are currently being scheduled out into March. Thank you again for your patience in this matter.

1/4/17 3.0L TDI Update:

As of December 20th VW and the government reached an agreement regarding the 83,000 affected 3.0L TDI vehicles in the US. The proposed Consent Decree would recall 63,000 affected 2013-2016 (Gen 1) vehicles to bring them into compliance with the emissions standards to which they were certified. VW would follow suit by offering a buyback or if approved an emissions modification for the 2009-2012 (Gen 1) vehicles. They also plan to spend $250 million in environmental remediation solely for the 3.0L TDI.

The proposed Consent Decree will only become effective after it receives Court approval, which at the earliest will occur during the spring of 2017. The court has set a deadline of Jan. 31, 2017 for the parties to submit a formal agreement to the Court. The remaining details remain confidential and part of the gag order surrounding the settlement.

Based on what we have learned with the 2.0L settlement I would not expect buybacks to start before the middle of 2017 and I would suspect the structure to be similar is offering NADA trade-in value as of November 2015 plus 20% restitution for current owners who owned the vehicle prior to Nov. 9, 2015. For lessees and those who choose the emissions modification I would expect the restitution to be 10-20% for Gen 1 vehicles. It is unclear what compensation will be offered to Gen 2 owners at this time.

Update 12/1/16

TDI buybacks have started in the dealership!!!

Yesterday, major improvements were made in increasing the number of available appointments for the buyback. If you have an appointment later than December 15th and would like to look at moving it up I suggest you try doing so through the portal. Please know the earliest appointment you can possibly receive is 14 days from date of schedule.

I also want to make you aware that VW is working diligently on the backlog of documents from customers and are actively pushing out formal offers by the thousands each day.

Please know 895 or 82% of our registrants have uploaded documents, of those only 26% of them have received formal offers, and only 30% of them have scheduled an appointment for 6% of our total registrants with an appointment.

Update 11/7/16

We have learned VW will not start the buyback process in dealerships until at least 11/17. We apologize for the wait and appreciate your patience in this matter. Please know the last steps in getting an appointment scheduled for a buyback is signing, notarizing, and mailing back the settlement agreement sent to your from VW. Emich VW will be offering notarizing services if needed.

Update 11/3/16

We have learned today that we are not expecting the Settlement Specialist from VW to arrive in our dealership to facilitate buybacks until 11/7 or 11/14. We apologize for the delay as VW is doing their best to accommodate the rapid registration of 370,000 or 75% of the class members in a short period of time. VW has increased call center staffing and boosted the capacity of their servers to help cope with the extremely high demand.

UPDATE 10/25/16

Today, Judge Charles R. Breyer signed the order granting final approval for the 2.0L TDI settlement agreement with private plaintiffs. This is another important milestone on our journey to make things right in the United States.

Now that we have approval we can begin administering the 2.0L settlement program. We have dedicated substantial resources in preparation for today, to ensure an efficient process both for our owners and for you, our dealer partners. You are a crucial part of this process and I am confident that with your help we will be able to provide a personalized and seamless experience for our customers.

We have already had an overwhelmingly positive customer response, with over 300,000 customers (over 50%) already registered. We have hired approximately 900 contract employees to work in customer support, claims processing, technical support and parts and vehicle logistics. As you know, eligible customers will now be able to schedule appointments at your dealerships with a dedicated settlement specialist, whose sole responsibility will be to complete vehicle buyback and lease termination transactions. We expect the first appointments to be scheduled in the coming weeks. Your Program Ambassadors will be key to ensuring that we stay ahead of our customers’ needs and that we remain on track.

Update 10/18/16

As you may know, today was the final approval hearing for the 2.0L TDI settlement agreement with private plaintiffs before Judge Charles R. Breyer of the United States District Court for the Northern District of California. Judge Breyer made favorable comments about the settlement and indicated that he would make a final ruling no later than October 25th. We will update you as soon as we have news.

SETTLEMENT PAYMENTS TO LESSEES

The tables below show the range of possible payment amounts to lessees under the Class Action Settlement. The amount you will be offered depends on your car’s model year, model, trim level, and factory options. The amount you will be offered will be the same whether you choose a Lease Termination or an Approved Emissions Modification or no longer have an active lease. The Approved Emissions Modification option will only be available if a modification is approved by the EPA and CARB.

These tables assume that you had a leased car with VW Credit, Inc. when the emissions accusations became public on September 18, 2015 and that you did not purchase that car on or before June 28, 2016. If you purchased your leased car on or before June 28, 2016, then you are considered an owner and should use the tables on the previous two pages to find your payment range.

[1] Vehicle registrations for owners/lessees (non-Volkswagen/Audi dealers) will be verified by records of a state Department of Motor Vehicles or an equivalent agency. For non-Volkswagen/Audi dealers, ownership will be determined by title or bill of sale.

[2] For Eligible Owners, Vehicle Value is based on pre-September 18, 2015 market value adjusted for options and mileage. For Eligible Lessees, Vehicle Value is based on pre-September 18, 2015 market value adjusted for options but not mileage.

[3] The Owner Restitution Payment is the same whether you choose a Buyback or an Approved Emissions Modification. An Eligible Owner whose Eligible Vehicle is totaled after the opt-out deadline will receive the Owner Restitution Payment, but no Vehicle Value.

UPDATE 7/27/16:

Yesterday the Court granted preliminary approval to the settlement agreement Volkswagen reached last month with private plaintiffs to resolve civil claims regarding 2.0L TDI vehicles in the United States.

While this agreement is still subject to final approval, yesterday marks another significant step forward on our path to making things right. Affected customers will now receive notification of their rights and options under the agreement and we will begin the 2.0L TDI settlement program as soon as the Court grants final approval to the class settlement, which is anticipated in fall 2016. We believe that the proposed settlement program will provide a fair and reasonable resolution for our affected customers and that it will also serve as an important building block as we seek to rebuild trust.

As we explained in the Dealer Meetings over the last few weeks, we are devoting substantial resources to the logistics of the settlement program. Its implementation is a significant undertaking and we want to make sure that the experience is as seamless as possible for customers and for you.

The Settlement website, VWCourtSettlement.com has been updated with new information, FAQs, the ability for individuals to determine if they may be eligible and if so, to link them to an Online Claims Portal. We encourage you to direct your customers there to learn more. Additionally, the phone number below are both now live to provide assistance.

1. Overview of Settlements
The Court has approved settlements entered into between Volkswagen Group of America and the United States and California (the U.S. Department of Justice on behalf of the Environmental Protection Agency, the California Air Resources Board, and the California Attorney General); the U.S. Federal Trade Commission; and a class comprised of owners and lessees of 2.0-liter VW/Audi vehicles. Under the Settlements, consumers will choose whether to accept a buyback/lease termination or to retain their vehicle and receive an approved emissions modification (if and when it becomes available). All three options include cash payments to owners and lessees. In addition, some former owners/lessees are entitled to cash payments. Volkswagen has also agreed to pay for environmental remediation and invest in zero emission vehicle technology.
The parties filed the proposed Settlement documents with the Court on June 28, 2016 and the Court has now approved the Settlement documents. Dealers should encourage affected customers to participate in the Settlements. Dealers cannot offer customers any compensation or benefits that interfere with, or dissuade, customer participation in the Settlements.

2. Eligible Vehicles

3. Informational Website and Toll-Free Number
Customers requesting information should be directed to the settlement website for more details: www.VWCourtSettlement.com or www.AudiCourtSettlement.com. Here, customers will be able to determine program eligibility, review specific settlement options, consult a list of Frequently asked Questions, and obtain a link to important settlement documents filed with the Court. We will also have a Customer Support and Administration team to take calls and answer questions at 844-98-CLAIM.

4. Claims Portal
An online Claims Portal is available for customers to: obtain information about the settlements and their options under them including restitution amounts, claims submission, and appointment scheduling at dealerships for buybacks/lease terminations and approved emissions modifications. Upon confirmation that a customer is eligible to participate in the Settlements, a customer will then select a buyback/lease termination or an approved emissions modification, all of which involve a cash payment. Certain former owners and lessees may also use the claims portal to determine their eligibility for a cash payment and submit claims.

5. Dealer Role in Handling Buybacks, Lease Terminations, and Emissions Modifications
Dealership Program Ambassadors within each store will be nominated and trained to support processes for buybacks, lease terminations, and (if approved by regulators) emissions modifications. Eligible customers will schedule appointments for these online or by phone. The Company and third-party Settlement Specialists will process all payments to customers.

6. Dealer Role in Handling Buybacks/Lease Terminations
Buyback transactions will be executed between VWGoA and the customer and facilitated by a third-party Settlement Specialist at the dealership of the customer’s choice. Dealerships will have certain duties and obligations to maintain the integrity of the transaction and the vehicle post-buyback/lease termination until it is modified and resold or removed from the dealership by VWGoA.

7. Dealer Role in Handling Emissions Modifications
Any approved emissions modifications will be managed through normal dealer service scheduling processes, and customers will be encouraged to schedule appointments through the dealership’s online scheduling tool. We will provide customers who choose an emissions modification with an Extended Emissions Warranty covering all parts and labor. Dealers cannot charge customers any fees related to this warranty service. In certain circumstances, Dealers will provide loaners to customers who choose the emissions modification. Details regarding process and dealer responsibilities will be communicated through the regional support structure.

Late in the evening on September 18th we learned that the EPA had announced that VW had lost emission certification for their 2016 2.0L TDI models. Subsequently Volkswagen admitted to cheating on emissions tests since 2009, affecting approximately 500,000 vehicles. We were and still are shocked and saddened by the news. We have recommended TDI technology to friends, family, and customers since our start in 2006. It has been a pillar of our brand and we are embarrassed for what has been exposed. As you may or may not know Volkswagen AG in Germany has hired lawyers in both Germany and the US to investigate this unlawful behavior of engineers and technicians and the CEO Dr. Martin Winterkorn has stepped down.

VW is currently working with the EPA to obtain certification of their 2016 2.0L and 3.0L TDI models and a solution for the 2009-2015 models already on the road. Please know they are working at full speed and we expect a solution soon. If you are driving an affected vehicle know that it is safe to drive and there are no actions necessary at this point. On April 21st we learned that VW and federal judge Charles Breyer, proceeding over the case came to an agreement, on the framework of a settlement. Although both parties are unable to discuss the details of the deal due to a gag order, some details were leaked to the media. From our understanding VW will offer to either buy back the affected vehicles for a value based on before the news of the TDI scandal broke or fix the vehicles. We are also expecting there to be some monitory compensation for both scenarios above the TDI Goodwill package.
